Terms and Conditions

1. General

1.1. These General Terms and Conditions of Business are applicable to all services provided by
FAVEDUCATION (“the Services”, “the Centre”, “We”, “Our”, “Us”, FAVEDUCATION”).

1.2. You are the natural person who is presently visiting Our site in Your own individual capacity
and/or behalf of Your company (“Client”, “You”, “Your”, “Yours”).

1.3. By continuing to use our site and services, You acknowledge and agree that You have read,
understood, accepted and agreed with these Terms of Business.

1.4. You shall accept FAVEDUCATION’s General Terms & Conditions of Business and the price valid at the time of the acceptance of service. Deviating terms and conditions of You or Your business cannot be recognized as a matter of principle.

1.5. Additional terms and conditions may apply to services offered via an online or app of
FAVEDUCATION.

 

2. Contractual Performance and Clients’ Responsibilities

2.1. FAVEDUCATION shall perform the Services in accordance to FAVEDUCATION customary
manner unless otherwise agreed in writing.

2.2. FAVEDUCATION, at its sole discretion, reserves the right not to undertake the Services and
terminate the agreement in the event the client fails to comply with the terms and
conditions set out herein.

2.3. The client warrants that all information and/or documents supplied to FAVEDUCATION are
accurate and correct in all aspects and shall indemnify FAVEDUCATION for all loss and damages arising from the Services herein caused by incorrect information and/or documents supplied by the client.

 

3. Terms of Payment, Prices

3.1. All prices for Education Services as stated on FAVEDUCATION’s website are in Singapore
Dollars.

3.2. Prices for Education Services stated are nett.

3.3. Payment for month is to be made by the second week of the month. A late fee $30 will be
imposed if payment is made after the second week of the month.

3.4. If You do not pay in full and on time, FAVEDUCATION reserves the right to suspend and/or
terminate You or Your Child’s Education Services, without refund.

3.5. FAVEDUCATION reserves the right to change the prices of the Education Services at any
time in FAVEDUCATION’s sole and absolute discretion, without any need to notify the Client.

3.6. Unless a fixed price or other calculation basis has been explicitly agreed upon, services shall be billed in accordance with the prices of FAVEDUCATION valid at the time of agreement.

 

 

4. Refund

4.1. Fees paid are non-refundable. For termination, please provide us a written notice of withdrawal at least one-month before the termination date. The one-month deposit will be
used to offset the last month’s fee.

 

5. Lesson Materials

5.1. You acknowledge and agree that:

5.1.1. The monthly tuition fees include lesson materials (notes, worksheets, tests). However,
additional fees will be incurred if a reprint is required due to missing materials that resulted by Your Child’s negligence;

5.2. You and/or Your Child are not allowed to share or disseminate any materials provided by
the Centre to anyone who is not a student from the Centre;

5.3. If You are found to commit the above offence, You and/or Your Child may be subjected to
instant dismissal from the Centre, with no refund.

 

6. Intellectual Property

6.1. The intellectual property rights owned by FAVEDUCATION and made available to You or
Your Child shall remain as the absolute property of FAVEDUCATION.

6.2. All intellectual property rights in notes, worksheets, tests and lesson materials created,
published and distributed by the Centre are, and remain, the property of FAVEDUCATION.

6.3. There is nothing in these Terms of Business that grants You and/or Your Child any rights or
ownership of any FAVEDUCATION’s intellectual property.

6.4. You acknowledge and agree that:

6.4.1. You shall not (and shall not permit anyone else to) disclose, reproduce, copy, modify,
post, distribute, upload, share, sell or otherwise take or use any of FAVEDUCATION’s Intellectual Property.

6.4.2. If there is a breach of Clause 6.4.1., You and/or Your Child may be subjected to instant
dismissal from the Centre, with no refund.

6.5. FAVEDUCATION reserves all rights at all times for all of FAVEDUCATION’s intellectual
property.

6.6. You acknowledge and agree that You will be liable for FAVEDUCATION’s Claims and Losses if
You are found responsible for any unauthorised use or reproduction of FAVEDUCATION’s
intellectual property rights, either authorised, permitted or enabled by You or by any Third
Party affiliated with You.

 

7. Photographs/Recordings

7.1. You and/or Your Child acknowledge and agree that:

7.1.1. You and/or Your Child permits the Centre to record Your Child’s image, voice and work
for marketing and educational purposes;

7.1.2. You/Your Child will fill up the opt-out form in the event if You do not want Your Child’s image, voice or work to be recorded by the Centre. [Link to opt-out form]

7.1.3. You and/or Your Child are not allowed to take any photographs, videos and/or
recordings within the premise unless prior consent from the Centre has been obtained;

7.1.4. You and/or Your Child are prohibited from recording the lessons in any form, including
but not limited to photos, screenshots, video and audio; and

7.1.5. If You and/or Your Child are found recording any part of the lessons, You and/or Your
Child will be subjected to instant dismissal from the Centre, with no refund.

7.2. Surveillance systems are installed within the premise for safety purposes.

 

8. Centre Premise Access

8.1. You acknowledge and agree that Your and Your Child’s access to the centre premises shall
always be strictly subject to, and conditional upon the following:

8.1.1. Reasonable access being solely for the purpose of receiving Educational Services;

8.1.2. Access being subject to, and consistent with, all applicable FAVEDUCATION policies.

8.1.3. Access occurring only during Business Hours;

8.1.4. You and your Child identifying themselves properly prior to entering the relevant premise;

8.1.5. You and your Child complying immediately and fully with all instructions given by FAVEDUCATION’s Personnel;

8.1.6. You and Your Child taking all reasonable measures to ensure that You and Your Child do not jeopardize or interfere with the health and safety of any other Person at the
premise;

8.1.7. You and Your Child’s entry into the premise being entirely at your own risk; and

8.1.8. FAVEDUCATION has no responsibility and/or liability for any Loss or Claim relating to You and Your Child if You or Your Child loiter without permission, or in other ways remove Yourself from FAVEDUCATION Personnel’s supervision.

8.2. If You and/or Your Child fail to comply with any of the requirements of these Terms of
Business or any of FAVEDUCATION’s instructions, FAVEDUCATION may in its sole discretion,
and at your cost and expense:

8.2.1. Remove You and/or Your Child from the premise;

8.2.2. Deny You and/or Your Child access to the premise; and/or

8.2.3. Subject further restriction access on You and/or Your Child as FAVEDUCATION deems
appropriate.

8.3. You acknowledge and agree that any breach of You or Your Child of any of the obligations
shall be deemed as a breach of these Terms of Business and you shall indemnify FAVEDUCATION for any resulting loss or claim.

 

9. Centre’s Rights

9.1. Course fees and schedules may be changed and services offered may be withdrawn at any
time.

9.2. FAVEDUCATION reserves the right to conduct the lessons in any manner it deems appropriate.

9.3. The Centre reserves the right to change tutors if it deems necessary.

 

10. Your Status

10.1. By submitting any information through the FAVEDUCATION platform, You warrant
and represent to FAVEDUCATION that You are at least 18 years of age; You have read,
understood and accepted these Terms of Business; You have the requisite legal authority to
do so where You are requesting Education Services for Your child.

 

11. Your Obligations

11.1 To enable FAVEDUCATION to provide and/or perform the Services, You, and/or You shall
ensure that the Student(s) that You are enrolling the Education Services in relation to, shall
ensure that:

11.1.1. You inform FAVEDUCATION of any health or medical conditions, disabilities or allergies that the Student has or subsequently develops, whether long-term or short-
term, including any infections;

11.1.2. You provide all instructions, information and documents required for FAVEDUCATION to perform the Services in a pro-active, responsive and/or timely manner;

11.1.3. All information which You provide is correct, complete and not misleading;

11.1.4. You notify FAVEDUCATION immediately if there are any changes to the information provided to FAVEDUCATION;

11.1.5. You comply with all FAVEDUCATION policies;

11.1.6. You comply with all instructions; and

11.1.7. You read, understand and comply with all instructions and materials provided by FAVEDUCATION.

11.2. You warrant and represent to FAVEDUCATION that:

11.2.1. All information You provide to FAVEDUCATION is true and accurate and
FAVEDUCATION may rely on the same without the need for further verification;

11.2.2. You shall not, and you shall ensure that the Student that you enrol for in relation to
shall not breach any terms set out in these Terms of Business.

11.2.3. You shall not (and shall not permit anyone else to) reproduce, modify, distribute,
post, disclose, or otherwise take or use FAVEDUCATION’s intellectual property rights.

11.3. You acknowledge and agree that FAVEDUCATION:

11.3.1. Supply the Services on an ‘as is’ basis; and

11.3.2. Subject to Clause 7.4., hereby exclude all conditions, warranties, representations or
other terms (whether express, implied or otherwise) which may apply to the supply of
the Education Services to the maximum extent permitted by Applicable Law.

11.4. Nothing in these Terms of Business shall be interpreted to exclude, restrict or modify
any rights or remedies available to You under Applicable Law, which cannot be excluded,
restricted or modified.

 

12. Illness

12.1. You acknowledge and agree that:

12.1.1. You shall not bring Your Child to the Centre if Your Child is feeling unwell and/or having symptoms and/or having any diseases (such as coughing, sneezing, vomiting, rashes, chickenpox, measles or hand, foot, mouth disease)

12.1.2. You must inform the Centre of Your Child’s medical or any other conditions.

 

13. No Bullying

13.1. You or Your Child are expected to behave responsibly at all times.

13.2. You acknowledge and agree that:

13.2.1. Your Child’s rights and freedoms are balanced with the lawful needs and rules of
FAVEDUCATION, and the rights and freedoms of others at the premises;

13.2.2. In the event if Your Child is deemed to have intimidated another person
intentionally and/or deliberately through emotional, physical, psychological and/or
technological means, Your Child may be removed and/or banned from the premises,
without refund;

13.2.3. Bullying, aggressiveness, overly disruptive, or other socially inappropriate acts are
not tolerated by FAVEDUCATION. Your Child may be removed and/or banned from the
premise, without refund in the event if Your Child violate the policies.

14. Termination

14.1. FAVEDUCATION may immediately terminate any contract with You under these
Terms of Business at any time before delivery and for whatever reason, by notice to You.

14.2. If FAVEDUCATION terminates any contract with You for whatever reason,
FAVEDUCATION will send You an email or text notifying You of the same.

14.3. Upon termination of any Contract by FAVEDUCATION, You acknowledge and agree
that FAVEDUCATION shall have no further liability to You.

14.4. Upon receipt of a termination notice, You shall:

14.4.1. Take all possible action at your own cost and expense to fetch and ensure the safety
of Your Child;

14.4.2. Take all possible action to mitigate any liabilities which may arise as a result of such
termination;

14.4.3. All outstanding payments will become due immediately.

14.5. You shall have no right to terminate any contract unless there is a written notice
provided one-month in advance.

15. Liability

15.1. You acknowledge and agree that FAVEDUCATION (together with FAVEDUCATION’s
management, directors, employees, officers, representatives, affiliates, providers and third
parties) shall not be liable to You for any losses and/or liabilities whatsoever arising out of
or in connection with:

15.1.1. Your and Your Child’s use of FAVEDUCTION’s platform or the Education Services;

15.1.2. Your and Your Child’s inability to use FAVEDUCATION’s platform and/or Education
Services;

15.1.3. Any inaccuracy or other defect in any document or information You supply;

15.1.4. The actions or failure to act by You or Your Child, or any Third Party at the premise;

15.1.5. Any failure of the Education Services to be performed, in part of in full, due to any
unforeseen circumstances beyond FAVEDUCATION’s control, including Force Majeure
Event.

15.2. Subject to these Terms of Business and to the extent permitted by law,
FAVEDUCATION’s maximum aggregate liability to You arising out of or in connection with
these Terms of Business is limited to SGD $100.00 or the value of the relevant agreement
whichever is lower.

15.3. If FAVEDUCATION is ever found be liable to You under these Terms of Business,
FAVEDUCATION’s liability will only be to You, and not to any Third Party You deal with.

16. Liability for Injuries Due to Misbehavior

​

16.1. As part of our commitment to providing a safe and supportive environment for all children, we have established a set of rules and regulations that must be followed to ensure the well-being of everyone in our care.

​

16.1.1. In the event that a child is injured due to misbehavior or actions that are in direct violation of the centre's rules and regulations, the centre will not be held liable for any resulting injuries. Parents and guardians acknowledge that the safety guidelines and behavioral expectations are in place to protect all children, and that failure to adhere to these guidelines may lead to situations where the center cannot assume responsibility for injuries or accidents that occur as a result.

16.1.2. We encourage all parents and guardians to discuss the importance of following the centre's rules with their child to help ensure a safe and positive experience for everyone.

 

17. Indemnity

17.1. You acknowledge and agree that You shall fully indemnify, defend and hold
FAVEDUCATION harmless from and against any and all Claims, Losses and/or liabilities of
whatever nature suffered, sustained or incurred, arising out of or in connection with:

17.1.1. Your and/or Your Child’s use of the Education Services;

17.1.2. Any damage or loss caused by Yourself or Your Child to any of FAVEDUCATION’s
physical property and/or equipment (Which shall be calculated on a “replace as new”
basis); and

17.1.3. FAVEDUCATION’s use of any and all information that You submit to FAVEDUCATION
via FAVEDUCATION’s website or platform.

17.2. You shall indemnify FAVEDUCATION fully against all loss or damages suffered and
cost and expenses incurred by FAVEDUCATION and all claims by any third parties as a result
of provision of the Services (including but not limited to the supply of inaccurate
information and/or documents to FAVEDUCATION or any claim by third party for
infringement or intellectual property rights and/or for discovery of information and/or for
delivery of documents or products/equipment).

17.3. For the purpose of Clause 16.1. and 16.2., FAVEDUCATION shall be deemed to
include FAVEDUCATION’s management, directors, employees, officers, representatives,
affiliates, and providers).

17.4. You acknowledge and agree that:

17.4.1. The Centre will not be responsible or liable for the loss of any personal property at
the Centre’s premises;

17.4.2. The Centre will not be responsible for the whereabouts of Your Child after student
care and/or tuition class dismissal;

17.4.3. You are responsible to take note of Your Child’s dismissal timings and arrange for
prompt pick-up.

 

18. General Provisions

18.1. You shall not divulge or disclose any of FAVEDUCATION’s confidential information to
any Third Party without prior consent from FAVEDUCATION in writing.

18.2. You acknowledge and agree that:

18.2.1. FAVEDUCATION may communicate with You via email sent without encryption;

18.2.2. FAVEDUCATION will not be responsible for any loss or damage arising from any
unauthorised interception, redirection, copying or reading of emails including any
attachments; and

18.2.3. FAVEDUCATION will not be responsible for the effect on any computer system of
any emails, attachments or viruses which may be transmitted by this means.

19. Personal Data Protection Act (PDPA)

19.1. By engaging FAVEDUCATION for the Services, the client permits FAVEDUCATION to
use and/or process data, including personal data, for the proper performance of the
Services and for other permissible purposes.

 

20. Governing Law

20.1. The agreement for Services shall be governed by and construed in accordance with
the laws of Singapore.
